Summary of Records

This volume contains a bankruptcy register of cases kept by the Third District Court.

Scope and Content

This volume contains a bankruptcy register of cases begun 16 June 1874 through 31 August 1878. The register resembles a docket. Each case gives the name of the party or parties involved and a statement if the case is a voluntary or involuntary bankruptcy. For each case listed, dates various actions were taken are itemized. The actions are only briefly noted, for example: petition for adjudication, order to show cause, warrant of seizure filed, list of creditors filed, notice to assignee filed, etc.
Cases were conducted under federal bankruptcy laws enacted in 1867 and amended in 1874. Until 1874, cases were heard by the supreme court as a whole rather than by a supreme court judge presiding over a territorial district court. The third district included numerous counties during the territorial period. In 1878 the bankruptcy law was repealed. Although cases could be completed under the terms of the old law, no new petitions could be filed after 1 September. Thus while particular actionsof later dates may be entered, no new cases are contained in this register after the 31st of August.
The second half of the volume, beginning on page two hundred and not included in the filming, is an unrelated court calendar, series 6545.
