Summary of Records

A power of attorney is a legal document which authorizes someone to execute any conveyance of real estate as an agent or attorney for the owner. Powers of attorney are valid only after they have been acknowledged, certified and recorded (Utah Code, Annotated 57-1-8). The Washington County recorder did not keep a separate book for powers of attorney, but mixed them with deeds and other land related records. However, in accordance with Utah law (Utah Code, Annotated 17-21-6), she kept an index to powers of attorney which provides the date of filing and the book and page were recorded.

Scope and Content

Powers of attorney are valid only after they have been acknowledged, certified and recorded (Utah Code, Annotated 57-1-8). The Washington County recorder did not keep a separate book for powers of attorney, but mixed them with deeds and other land related records. However, in accordance with Utah law (Utah Code, Annotated 17-21-6), she kept an index to powers of attorney which provides the date of filing and the book and page were recorded. This index includes both the names of property owners and designated attorneys, and indicates when and if the power of attorney was revoked.
