Summary of Records

These records document the essential administrative and drafting functions of the ILRC as it recodified Title 31, Utah Insurance Code between May 1981 and February 1985.

Scope and Content

On March 11, 1981, the Utah State Legislature created the Insurance Law Revision Commission (ILRC) to rewrite Utah's insurance laws. These records document the essential administrative and drafting functions of the ILRC as it recodified Title 31, Utah Insurance Code between May 1981 and February 1985. Included in this series are correspondence; personnel records; budget statements; procedural guides and frequently used forms; newsletters, press releases, and Insurance Department publications; comments solicited from interested parties; reports to the state legislature; references pertinent to specific topical issues; and miscellaneous data and notes compiled to facilitate the drafting process. The records address, in great detail, the extent of and capacity in which numerous specific individuals were involved with the project; the basic financial operations of the commission, its members and staff in their official duties; the concerns and interests of both commission members,drafters, and interested outside parties as regarded specific sections and issues of the proposed code; and pertinent local issues situated in their broader national context. The commission's administrative offices were provided, in part, by the Department of Insurance, and together with the Office of Legislative Research and General Counsel, they provided staff assistance to the commission during a portion of its existence. This series contains the correspondence of Michael O. Leavitt as a member of the commission, prior to his election to the Governor's Office in 1993.
Reports and comments submitted by outside parties seeking input are included herein as thirty-five subfiles under file #26 and comprise the most substantive single set of records contained in the series. These comments provide an important window into the concerns of outside interested parties and document the commission's systematic effort to solicit public input on the proposed changes. These "outside" comments,however, differ significantly from comments submitted by the commission members and drafters directly involved in the drafting process (primarily included in the minutes and compiled drafts) and should be clearly distinguished from such.

Arrangement

Arrangement is numerical by file number, and thereunder predominantly in reverse chronological order by year, month, and day.

Many of the primary dated documents (such as letters and memoranda) are accompanied by numerous attending documents both dated and undated. Wherever possible such accompanying documents follow their primary document in their original order. As a result, significant spans of attending references between primary documents will proceed in no particular arrangement. Undated documents not clearly included as referents to a primary document will follow the overall chronological sequence at the back of each file folder in no particular order. Fifteen subject files follow the numbered file folders in alphabetical file name order.

Custody History

As head staff of the ILRC and the ICTF, Dane Leavitt maintained the records through most of the recodification project. At the conclusion of the project in March 1986, Mr. Leavitt stored them in his office building in Cedar City, Utah. He transferred the records to the State Archives in 9/2002.

Acquisition Information

These records were acquired from the creating agency through established retention schedules.

Processing Information

Rummaging by numerous researchers through the documents (over the 15 intervening years before their transfer to the Archives) left the records in a state of considerable disorder. Through archival processing the records have been returned to their original arrangement as far as was possible. Michael A. Church processed this series in the Spring and Summer of 2003. Prior to transferring the records, Dane Leavitt collected those with "the most probative value to the research of legislative history" into one box to facilitate such research. Identified as Box 1 of the original nine boxes transferred, this box included the March 25, 1983 initial draft (with extensive drafter's comments), the minutes of the ILRC and ICTF respectively, and miscellaneous documents related to SB 232 and its passing. During processing, these documents were returned to their original placement in the records' initial arrangement and notes included in the individual series inventories to direct researchers to
their final location.
