Schedule Description

These are loans which use personal property as collateral filed with the county recorder. They include the date due, lenders name and address, mortgagor's name and address, date of mortgage, amount of loan, installment payments, date of installments, contractual agreement, list of personal property held as collateral. Chattel mortgages are obsolete. In 1965, chattel mortgages were supplanted by the Uniform Commercial Code and in 1983 all mention of chattel mortgages was removed from the statutes of the county recorder. OBSOLETE RECORD

Scope and Content

The two mortgage volumes (labeled A and B) contain verbatim copies of chattel mortgages filed with the county recorder between 1890 and 1920. Chattel mortgages are loans taken out using personal property as collateral. Recorded information includes the names and addresses of the mortgagor and mortgagee, a list of personal property pledged as collateral, the amount money borrowed, the length and conditions of the loan, the amount of interest to be charged, a signed promissory note, sworn statements by each party, and a notarized statement that the mortgagor entered the agreement voluntarily. Volume A covers the period from 1890 to 1912 and includes its own index. Volume B spans 1911 to 1920 and is indexed in separate volumes as described below. Included in this series are seven index volumes. Recorded information includes the filing number, the date of instrument and time of filing, the book and page number of the mortgage agreement, from (mortgagor), to (mortgagee), consideration (amount of loan), and remarks (personal property pledged as collateral). The brown volume indexes mortgages recorded in books A, B, C, and D between 1897 and 1920. The green binder indexes mortgages recorded in books C, D, E, and I between 1920 and 1929. The black binder indexes those recorded in books C and D between 1920 and 1940. A tan binder indexes mortgages recorded between 1940 and 1943. Volume No._3 indexes mortgages between 1943 and 1953. Volume No._4, which indexes mortgages taken out between 1953 and 1964, comes in two separate parts. The part labeled "From" is an index to mortgagors while the part labeled "To" is an index to mortgagees. Chattel mortgages became obsolete in 1965 when they were supplanted by the Uniform Commercial Code (which is found in "Laws of Utah, 1965," Chapter 154).
