Summary of Records

This series contains registers used to record actions taken and the corresponding documents filed in each case presented to the probate division of the court. In addition to handling the estates of deceased persons, the probate division also deals with adoptions, guardianships, and insanity and incompetency cases.

Scope and Content

This series contains registers used to record actions taken and the corresponding documents filed in each case presented to the probate division of the court. In addition to handling the estates of deceased persons, the probate division also deals with adoptions, guardianships, and insanity and incompetency cases. The court is responsible for adjudicating and conveying ownership of town site lands (Utah Code, 57-7-19, 1953). Occasionally, the court handles name changes and inquests regarding the cause of a death. In each case the probate register indicates the name or names of the individuals involved, the kind of case, and the name of the petitioner's attorney, followed by a list of each action taken in the case and the date that action was taken.

Gaps

It appears that the court began renumbering case files beginning in 1908 in Book 2. The book includes a case from as early as 1895, but does not seem to contain all the cases that would have been heard by the court between 1895 and 1908. There may have been a Book 1, which would have covered those cases, but the whereabouts of such a book are unknown.

Access Restrictions

This series is primarily classified as Public. The secondary classification is Exempt: As of 1 July 1999, records of adoptions are restricted for 100 years and are only fully accessible by court order. These books include lists of actions in adoption cases. UCA 78-30-15 (2008).

Custody History

These books were transferred to the State Archives from the court in 2007. They were transferred to the regional repository at Southern Utah University in November 2009. The University Special Collections returned the original books to the State Archives in October 2025.

These records were acquired from the creating agency through established retention schedules.

Processing Information

This series was archivally processed by Jim Kichas and Emily Gurr in April 2008 as part of a NHPRC grant project designed to preserve the historic records of Utah's Fifth District Courts. The finding aid was updated by Alan B. Barnett in November 2025 after the original books returned to the State Archives.
