Schedule Description

These are bonds with good and sufficient sureties, payable to the municipality for the "elected officers of each municipality and the treasurer in cities of the first and second class before taking the oath of office" to guarantee "faithful performance of the duties of the respective officers." Bonds are placed at such amounts as may be determined by the governing body (UCA 10-3-819 (1997)).

Scope and Content

This series contains bonds and oaths of office submitted to the Town of Ophir on behalf of elected and appointed municipal officials. City officials were legally required to be bonded in the amount of $250 or $500, depending on the office held. All the bonds are issued in late December or early January, which coincided with the start of municipal terms at the beginning of even years. Most of the bonds are issued by the American Surety Company. The bonds typically include such information as the name of the official or "principal," the bond sum, the office held by the principal, the beginning date of the term, signatures of the principal and representatives of the surety company, along with an affidavit signed by one of the representatives. The oaths include the office, name of the office holder, signatures of the office holder and notary public, and the beginning date of the term.

Notes

The records in this series were located in an unorganized box of documents in the Ophir Town Hall, a building without regular climate control systems.  The State Archives borrowed the records in 2014 for microfilming.  While the records were fairly clean, many of the documents were bent or folded.  The records were humidified and flattened and any metal fasteners were removed before being organized and housed in archival folders and boxes.  State Archives staff requested that the records be transferred to the Archives for long-term preservation, but the request was denied.

This series was microfilmed by the State Archives in September 2014 and the originals were returned to Ophir Town.
