Abstract

A temporary Constitutional Revision Study Commission was created in 1969 to examine the state constitution and amendments and to make recommendations to the governor and legislature as to proposed constitutional amendments or revisions. The Commission was made ongoing, rather than temporary, in 1977.

Biography/History Notes

Duties are specified as follows: Conduct a comprehensive examination of the Utah Constitution, as amended, and make recommendations to the governor and the Legislature as to specific proposed constitutional amendments to implement the commission's recommendations for changes in the constitution; and upon request, advise the governor and the Legislature on any proposed constitutional amendment or revision. The commission shall make any recommendation on a proposed constitutional amendment before both houses of the Legislature take final action on it. The Commission may hold public hearings to afford interested state citizens to appear and present views in respect to any subject relating to the work of the commission.

The commission is composed of 16 members: 3 appointed by the Speaker of the House from the House, not more than two from the same political party; 3 appointed by the President of the Senate from the Senate, not more than two from the same political party; 3 appointed by the Governor, not more than two from the same political party; the director of the Office of Legislative Research and General Counsel as an ex-officio member; and the 6 additional members selected by those previously listed members, with consideration given to geographical and bipartisan representation. Members served until July 1, 1977 when they moved to staggered six year terms (with five members' terms expiring every two years).

The Commission was initially authorized to hire staff. Starting in 1998, the Office of Legislative Research and General Counsel was to provide staffing, although the Commission could hire additional staff if so desired.
